HIPAA (Health Information Portability and Accountability Act – 1996) was passed by Congress and signed into law in 1996. It providers security provisions and data privacy to keep patients’ medical information safe. HITECH Act – 2009 (The Health Information Technology for Economic and Clinical Health Act) was enacted under the American Recovery and Reinvestment Act of 2009. HITECH provides incentives for adoption of electronic health records (EHR) systems among providers. Civil penalties and penalties for “willful neglect” and non-compliance were implemented with this law. “Unsecured patient health information” essentially means “unencrypted patient health information” (PHI).
